These Terms of Service govern your use of www.americanbusinessrecognition.com and the services offered under the name American Business Recognition (together, the "Service"). The Service is operated by Bold Latitude LLC, a Wyoming limited liability company ("we", "us" or "our"), with its principal office at 30 N Gould St, Sheridan, WY 82801, USA.
By using the Service you agree to these Terms. If you use the Service for a business, you confirm that you may bind that business. If you do not agree, please do not use the Service.
1. About the Service
The Service publishes a directory of United States businesses, calculates a Business Recognition Score from public information such as ratings and review counts shown on Google Maps, and awards recognition to businesses that meet our published standard. We also sell optional digital promotional materials and licenses.
American Business Recognition is a private program. It is not affiliated with, endorsed by or connected to any government agency.
2. Recognition is free
Recognition does not require payment and cannot be purchased. Buying a package has no effect on a score, a status, a directory position or any recognition decision.
3. Scores and recognition
Scores follow the methodology published on the Service. We may update the methodology, and we may correct a score or status if we find an error. Recognition applies to the year stated on the record and does not carry over automatically.
Recognition reflects public information available at the time of evaluation. It is not a guarantee, certification, license, endorsement or warranty of any business, product or service, and you should use your own judgment before hiring or buying from any business.
We may withdraw recognition if the underlying information was false or manipulated, if a business uses fake or incentivized reviews, or if a business breaches these Terms.
4. Business listings
Directory listings may be created from public information without a request from the business. A business owner or authorized representative may ask us to correct or remove a listing through our contact form. We may ask for proof of authority before acting.
5. Submissions
When you submit a business or other content, you confirm that it is accurate to the best of your knowledge and that you have the right to share it. You allow us to use it to operate the Service. Submitting a business does not guarantee a listing or recognition.
6. Orders and payment
Prices are shown in US dollars before any applicable tax. A package request is not a completed purchase. After a request we email a secure payment link from a third-party payment processor. We do not store full card numbers. Packages are one-time purchases unless the checkout page clearly states otherwise.
We may refuse or cancel an order if the business is not recognized, if the order appears fraudulent, or if a pricing error occurred. In that case we refund any amount paid.
7. Refunds
Digital materials are made available immediately after purchase, so sales are final once files have been made available, except where the law requires otherwise. If files cannot be delivered, or if recognition was withdrawn because of our own error, contact us within 14 days and we will fix the problem or refund the purchase.
8. License for promotional materials
A package gives the recognized business a limited, non-exclusive, non-transferable license to use the purchased certificate, badges and materials to promote its own recognition. Unless stated otherwise, the license lasts 12 months from purchase.
You may not alter the materials, imply a different year or score, imply government approval, use the materials for another business, or continue using them after the license ends or after recognition is withdrawn. Any promotional use must be truthful and must identify the year of recognition.
10. Sponsored blog features
The Premium package includes one article about the business on our blog. We may edit it for accuracy and clarity, and we may decline content that is misleading or unlawful. Each article is clearly labeled as sponsored. It does not change any score, status or directory position.
11. Acceptable use
You agree not to break the law through the Service, submit false information, impersonate anyone, interfere with the Service, or scrape or copy the directory in bulk without our written permission.
12. Intellectual property
The Service, including its text, design, logos, badges, certificates, scores and directory, belongs to us or our licensors and is protected by law. Except for the license described in these Terms, we grant you no rights in it.
13. Third-party content and links
The Service may refer to ratings or websites controlled by others, including Google Maps. We do not control and are not responsible for third-party content, and any ratings shown remain subject to their original sources. We are not affiliated with or endorsed by Google.
14. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that any business will gain customers or revenue from recognition.
15. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars.
16. Indemnification
You agree to defend and indemnify Bold Latitude LLC against third-party claims that result from your content, your use of promotional materials, or your breach of these Terms.
17. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Wyoming, unless the law of your place of residence requires otherwise. Nothing in these Terms removes consumer rights that cannot be waived.
18. Changes and termination
We may change these Terms by posting a new version with a new date. Continued use after that date means you accept the change. We may suspend or end access to the Service if you breach these Terms.
